Anybody been through an ID theft? We had a credit card cloned a few months ago, somebody went on a shopping spree and cleared out our checking account. The bank fixed it after a little pestering.
Now we've got a collections agency calling claiming that we owe money to a bank in a state I've never even been to. I don't know if it's related to the cloned credit card or something new. I checked 2 of the 3 credit agencies and saw nothing about this other bank and when they called they had our first and last name and knew the last 4 digits of the SS# but they had the wrong middle name.
Any tips? I'm doing research on the collections agency and bank that claims we owe them money. I can't afford an attorney. I'm considering filing a fraud alert with the 3 credit agencies but haven't found anything out of the ordinary in the 2 I checked. If the bank did open an account with our social security # but with an obvious incorrect name doesn't that prove they were negligent and open them to a lawsuit (I'm obviously very pissed at them)? Also of note, I'm recording all my phone calls with the collections agency and writing extensive notes in case I need to do any legal action.

Don't give them any information. Could well be the ID theives fishing for more info.

Well getting in touch with the credit agencies is your first step and also have the bank who set the account up send you any paperwork or info they have on the account. In terms of recording phone calls if you live in Georgia as you say in your profile it is illegal and a felony in that state to do that.

You need to work with the banks. Call, email, etc to help them make sure you are who you say you are.
Never trust the collection agencies.
I heard stories about fake collection agencies who victimize people who have had ID theft.

Just to clarify, I wasn't "secretly" recording my phone calls ... they had an automated message that said "you phone call may be recorded" and I responded back that I was also recording the phone call. I'm not a lawyer, but if they can notify me of recording without talking to me, I'll return the favor.

Regardless of recording indication, while it maybe legal or illegal, you cant use it in code of law for in matters criminal or civil.

BTW, collection agencies now a days, say they are cops, etc
Record and verify their story but most of all deal with banks only. They will call off the dogs.
