NDA states: Effective Date and Length of Obligation "This agreement is effective as of the last date of execution by both parties and may be terminated by either party at any time upon written notice. Parties obligation of confidentiality and non-use of Confidential Information hereunder shall last for five (5) years from the date of such written notice."
When the new owner purchased the site he asked the old owner about who was doing the design and the original owner stated "due to my designer(s) signing a NDA I'm not at liberty to divulge that information."
The NDA loosely implies that any and all information related to the website, whether labeled as confidential or not, is protected under this agreement.
So I don't know
You should really stick around and get paid.
Seriously. They need you now, and I bet this new guy is willing to pay for it this time 'round. Explain that the incomplete package is due to failure to compensate, and that compensation will complete the job. It's just business. Or, ignore the old fight and just give him a flat rate to finish. Don't walk away now.
you're in the power position. why walk away?
About a year ago I did freelance web work for a company and signed a NDA. The original owner has sold the company/site to a new owner and I was recently contacted by the new owner. He found me from my website and wants me to continue working on the website.
I got screwed by the original owner for a few hundred bucks and our subsequent phone/email back and forth got heated and litigious though I ultimately decided to walk away and cut my losses.
The new owner was sent an incomplete folder of files for the website and a bunch of stuff is missing. Turns out I possess all these missing files and am aware of all the third party sites needed to "complete" this fucking disaster of a pathetic website.
*as I'm writing this, kinda drunk, I'm saying to myself "wtf am I doing worrying about this bull$hit - move on asshole" but I digress.
You know what, fuck it - this post has inspired me to walk away from the project - fuck them, I'm tired of bullshit - end of thread - thanks!
