My sister does alot of print, my brother does web, and I do alot of video and motion. We are thinking of starting a little company. Would it be honest if I build a site for the company and say this is what we have done and basically put up my sisters portfolio, my brothers portfolio, and my own?
I think it could be misleading because its not work we have done as a company, but it is work everyone in the company has done and it definetly shows off what we are capable of, which I feel is the point.
What do you guys think?

I would, as long as the work is done by the people who are claiming it's done by.
Be sure that any commercial work is displayed with the permission of the client who paid for it though and if necessary you can always say "work done while working for xx"
Your site is your showcase and this is a common way to have an immediate portfolio of work for your new company.

you can't promote a company with another company's work.
you can promote yourself (as in, "here's stuff i did at my last job. hire me, please."), but that is not the same thing as, "All In The Family Media... look at our client list."

seriously, if the work was all made freelance then it is perfectly ok.
it is about showing your skills after all.
if all the work was made when you were employed at another design firm it would legally be more tricky.
still if you want to go ahead with it, you should have a password protected portfolio, only available on request..

When you all worked under different companies, did you ever sign a "non-compete" clause?
If so, that may cause problems.

you have to be an idiot to sign a non-compete agreement as a designer...
if you are a coder... then you will sign a non-compete in the same industry.... or that for a time period of 2 years or something...
normally its just an NDA...which is fine as long as you don't disclose secrets you learned publically

non-compete clause's are not legally binding. you can work for whoever you want including yourself.
