Image Rights Question

I've been asked to place an "Indianapolis Colts image" into a layout to help promote an auction item for a charity. I think there are going to be some legal issues with that.
Seeing as it's for charity, they have no budget.
What I was wondering is whether I can go onto flickr and pick up an image that's fair use (or whatever the term is), or if that's still a legal issue because it's using their logo, their players' likeness, etc etc.
Here's hoping you guys can help.
Thanks!

nfl is really pissy about their copyrights
but since it was donated, i would think it is authenticated and therefore would surely be allowed.

Yeah there are layers of NFL brand approval on that...if you're going legit.
But if no one outside the auction is ever going to see it, I wouldn't get too concerned.
You're not personally liable anyway.

It's an image of the item that's being auctioned?
- Nah. they want an image of Peyton manning or the Colts on the field.Gucci

Well.... it was donated by a third party - not the NFL. So I think you just answered my question.

when it comes to the NFL, you should have permission to use any imagery. Grabbing something from flickr won't save you from a legal notice. We've had discussions with one of our clients, FOX Sports, about using NFL team branding before. The legal back and forth was par for the course.

yeah, on one had it's the colts and therefore i have no idea if that likeness is still owned by the nfl or is public domain,
and on the other, it is just to promote an auction. it's not like you're selling bootlegged copies of the superbowl for personal profit
- nevermind on first point, i read baltimore colts7point34
- doesn't matter.zenmasterfoo

Cool. Thanks guys.
Better to be safe than sorry... even if these fuckers are laying me off and still giving me new projects to work on.

Maybe photoshop some dangly cocks on the people in the background? That'll learn em.
