I am fed up with the mighty mouse and its constant failing scrolling nipple.
Magic mouse feels to flat to be a proper working mouse.
Anything else out there that can be recommended?

yeah, you are in luck. there happens to be sh!t loads of mice out there. Google it.
i happens to like the k.i.s.s. mantra. the more crap they put in them pointing devices the worse they seem to get. so for me. its a 10 dollar microsoft comfort optical.
- but dont install them crappy drivers. usb/defaults keeps it running tiptop.plash

the best mouse to design with is probably a pen and tablet.

^^ I find tablets are better for line trace and illustration. cant stand tablet web surfing.

I've had my logitech mx510 for about 5 years. Get the newer version of that, it's a great mouse. Good for some good ole work avoiding gamin too.

why would you want to design with a mouse

Once I used the Magic Mouse for a couple hours, I got used to it. It's really a good mouse. I recommend it for "design" or just surfing porn.

I've got the Connexion 3D Spacenavigator and whilst I've waxed on about it here in the past I NEVER use it in Photoshop, and simply can't use it in Illustrator, which is hella annoying.
If you only do 2D work, you do NOT need this.
If, however, you do any 3D work - any at all, get one.
They're fucking brilliant.
As for the mouse - I went off Logitech and Microsoft mice a few years ago - they're great, don't get me wrong.... but I sometimes play games too, and the range from Razer are really really good.
A mouse that's good for games is a mouse that's good for design work, too. Aside from the comfort, high tracking and build quality, it also has 4 programmable buttons which, although I only use intermittently in PS or Illy, I do sometimes find useful.
Razer mice are gaudy as fuck though - I do get a little embarrased when clients or non-geeks come by..

3Dconnexion: secondary input device
p.s. Photoshop: twist to change brush size- Aye but it's shit. If you do work for 3DC, can you get them to get off their asses and sort Illy compatability?detritus
- the device name is 3DConnexion, not 2DAppHacker. change your software3D
- or stop using a screwdriver to drive a nail3D
- Yet you've elected to mention its use in a thread dedicated to 2D input, specifically in reference to PS?detritus
