Anyone else watch this (HBO). Just finished the final episode and holy shit.
Guy who has beat conviction or charges on three murders dating back to 1982 makes an admission on tape because he didn't realize the mic was still on. Just arrested again. NYTimes has the story.

Apparently the audio could be used if they could prove that it was tampered with. Which might be tough to do. But these guys seem like they're pretty meticulous. If they kept good records maybe?
Doesn't bode well for the audio getting used though since it took them two years to discover that he had talked off camera. If they didn't know they had evidence in their hands they may not have treated the recordings as such.

I think that the film will show prosecutors how to do they job they need to do. Which is convince a jury of his guilt. Even if they don't get the confession tapes admitted they will have a pretty solid playbook for making their case. It's a story about three murders not one, and add to that the evidence that is admissible and you have a good case.
The last time he snuck out of it because he had the DA trying to prove a negative and they couldn't win with that.

In theory, he may have had an expectation of privacy while in the bathroom. However, the prosecution should be able to counter that by saying he was well aware his mic was 'hot'. He'd been warned by his lawyer in a previous interview of exactly this.
My guess is this was all a game for Durst. He thought he was smarter than everyone else and he's sailed closer & closer to the wind knowing that he would eventually be nailed for one of these murders.

"NEW ORLEANS (AP) – A Louisiana State Police trooper says millionaire Robert Durst has been booked on weapons charges in that state – on top of a first-degree murder charge lodged by Los Angeles authorities. Trooper Melissa Matey told the Associated Press that an arrest warrant was issued for the former Limp Bizkit frontman and he was rebooked in the Orleans Parish Jail on Monday under two new charges," an AP report said.
