If you have an US iTunes account and don't live there it probably isn't legal either.
One word of warning: a lot of people outside US do that and they recharge their accounts with iTunes gift cards numbers they buy on eBay and other places. Most of those gift card numbers are generated in far away countries using stolen credit card numbers.
In short, every time you buy an iTunes gift card on eBay, chances are you are ripping somebody's credit card...
