Hosting rights?

Do I have any? Recently someone in my organization renewed a year's contract of hosting with a firm I don't particularly like. They are refusing to upgrade to PHP5, which is a feature that I desperately need. And to top that they're down at the moment.
In their policy it says that they do not offer refunds, do I have any way out whilst getting my money back too?

ofcourse you can. if a company doesn't do what it is supposed to do then you can do something about it. even if they say they don't offer refunds which is bs btw.

upgrading to php5 is not a valid issue btw but too much downtime is a valid issue.

Oh well, the site is back up. But I mean isnt this tricky because they never advertised their services as having PHP5 when I registered if you think about it...

It was not me that renewed the service. My only beef now is that PHP5 isnt installed, an they are flat out refusing to install it inedfinitely.

I know that it is possible to do this with PHP4, except its a whole lot easier in PHP5 haha

dude, hardly no isp upgrades to something new that fast. first it has to prove itself, has to be tested, checked etc. you must not forget that they are responsible for security issues. so if they install a new php version without looking and there's an exploit it's their fault. there's more to it than just installing you know.

well there you go. the whole argument is that it makes your life easier. if it was something so important that only runs under 5 than i'll understand your issue. not if it can still be done in 4.

btw i remember the days where every single php script you wrote had to be approved and checked for security flaws / possible exploits by the isp's tech dept. now that sucked.

regarding upgrading php5 you have no leg to stand on at all. that's like sueing mercedes benz for not using an upgraded air filter or something.

the isp i currentely use is quite progressive, just checked, still on php4. latest, but not on 5. it's not that standard. will take some time fer sure.
