they may not be legally binding but if you take them to court I think they can be used as evidence against someone. That's how they busted those enron fuckers i believe.

Depends on how good yours or the other party's lawyer is.

Emails are legally binding. To the fullest degree. They are a record of your words. If you have promised soemthing in an email adn then you fail to deliver, that email can be used against you in a legal situation.
The only exceptions are if you are able to prove that you didn't send the email - someone sent ot from your account - or that the circumstances under which you made the promise were subject to changes that can be shown to cancel all previous promises.
Might not be what you're asking, but still.

interesting, I'm about to take a client to court and all I have is emails, lots and lots of emails with them agreeing to the work and cost, promising to pay, apologising for not paying etc etc
So I hope they are... I imagine in this day and age that they are.

no
they can stand in court but aren't regarded as evidence of any contractual agreement- Disagree. In business your word is your bond. You word on record, if legitimate, is more so.Horp

Much like verbal agreement, it is legally binding. It can either serve as evidence or contract if there were terms agreed on work to be done.
Unlike verbal agreement, there is no hear say in email. You need to confirm the origin of the mail by opening up the source of the email which has the server path.

Yes they are legally binding. Make sure you print out the long headers. As a side note so are IM conversations.
