So, the company I work for is based in California. Our parent company is based is NY. Our parent company contacted me for access to our email lists so they could start emailing our customers.
I told them that this would be considered spam since the customer hadn't been notified that they would be receiving emails from our parent company, only us, when they opted in.
Even though we are technically the same company, wouldn't this be considered spam?

That depends entirely upon the agreement you put in front of your customer at the point they gave you their email.

Our opt-in statement is "Yes, email me about new XXX products, technology, seasonal trends and special promotions."
XXX is our company in California. It doesn't say anything about the parent company.

I get too much spam from apple and amazon. fuckign aholes
