This discussion is the difference between copying and deriving. Fairey derived his Obama image from an original photograph. It is in terms of artistic usage, drastically different from the original...no longer a photograph.
Werner copied Fairey's use of the word OBEY. Anyone who knows anything about art knows this word is trademarked by Fairey and is a part of his brand. As much as the target symbol and the swoosh...it is his "mark". Werner most likely used it thinking he'd get away with it or get some publicity out of it....which seems to be working.

there's also the issue that fairey 'derived' his 'obey' term from John Carpenter's 'They Live' where the term 'Obey', 'Consume' and 'Sleep'. So the question is that if he has admitted that this is the fact, how can he claim ownership?

As soon as I can draw it and print it, I am going to be selling an art print on my site that says OBEY prominently on it. It will be a limited edition print, no more than 100,000 will be produced. It will not be a rip of Fairey though becuase my work is original, not baed on a scan from a graphic design anthology hardback.

well, I bet he´s got quite a schedule; exhibitions, pr-appearances, his actual work, yadadum. If I was in his position I surely wouldn´t want to personally ok every cease and desist that´s being put out. it´s not that they are suing for damages, not a high profile decision really. so I doubt that he knew about this, the guy is not an idiot.
