Talk to your attorney about it and what can be done in your state.
My clause states that until full payment is made I own it all so if no payment is made I have the right to take it down since its still legally mine. They get warnings with the invoices and a grace period and then this is a perfect example of what happens:

If you got to ask yourself close the site, a bridge has tended. That shit is a bridge that burns with a fart or something else.
Do you have a contract?
What it says about what happens when"no pay"?
Why isn't the website hosted on a server in your property?
Do you charge an advance?

I've put up a page before that said "this site has been suspended due to insufficient funds". i got paid pretty quickly.
i've also put a few hidden php files that delete entire folders just incase you really have a problem.
NB: I work in a country with no viable legal system though.
