Hello all. I'm sure this has been covered numerous times on these forums but I was just wanted to get a feel what the consensus is now.
A few details on my situation; It's a potential new client who has basically asked us to pitch for a new children's IP their company (a well known company) is developing. It's pretty cool and we would like to work with them but we've encountered a few red flags. Firstly, they never mentioned it was a free pitch. It was only when we pressed them on it that they told us. Also they wanted us to sign a contract effectively signing over the designs to them for a pound. We pulled them up on this and they gave us an NDA instead.
We're hesitant to do this pitch as we don't agree with doing work for free but we would like to keep the door open if they decide to change their mind or would like to work with us. Any suggestions?

ideally you should get paid for pitch work
but if you want to pitch use the nda and state terms like they can't use the ideas and if they do you need $

Ask yourselves if you can afford to write off the investment in time/resource if you lose.

It'd be one thing if YOU/YOUR COMPANY were also pitching to the client alongside the other company, and you BOTH have a new client if u win the pitch. However, you're helping ANOTHER company win a new client. They should be paying you for that work. This is an expense they should be incurring, costs of potentially getting themselves a new client. Don't do spec work. Who's to say that if they do win the client, that they'll be using you to develop the actual thing?

sounds like a classic bait and switch.
Protect your creativity/work, make sure that that both sides are on the same road, and ensure clear understandings and expectations.

I do a bunch of work for a well know children's company. They are not shy about spending money and have never asked for free work. They are, however, very insistant on owning IP outright. They are willing to pay for it, though.

You've given them 2 chances already and they are still screwing around. You all know this is bad. Be brave and decline. It's OK to say no every now and then - specially when you already have a bad feeling.

It's only a pitch, if you approach the client with your concept.
If the client is asking you to do work without respecting you enough to think that you deserve to get paid (Specially if they are a big company) for said work, it's not a pitch. That's called something else, I can't quite remember what it's called..How about some help on the note section haha --->

Once had a client (German top grocery store chain) that pitched. Didn't pay us and no other agency 'won'. Months later, I almost had forgotten about that, I am in line at said store and have to see the campaign that I have developed done by their own intern-driven graphic department.
Shortly after this I decided not to work in the advertising business anymore because I always felt betrayed and surrounded by dishonest people. There was just too much of it, only had such experiences.

Don't get me wrong, I still do some free work here and there but on my own terms, and if and only if, I believe in a project so much and feel like I will get something out of it even if it's not money.
