Coldplay Accused Of Ripping Off "Viva La Vida"

Less than 48 hours after just about sweeping the 2009 Grammy nominations with seven nods, Coldplay have had the wind taken out of their sails a bit with yet another accusation of plagiarism involving Record of the Year nominated song "Viva La Vida."It's not the first time (Brooklyn outfit Creaky Boards said Chris Martin saw them at CMJ and ripped off their melody), but this time rock guitarist Joe Satriani is actually suing. Satriani's copyright infringement suit, filed Thursday in L.A. federal court according to Reuters, alleges that "Viva La Vida" features "substantial original portions" of his 2004 instrumental track "If I Could Fly."
Satriani wants a jury trial, damages and -- we're not kidding -- any and all profits attributable to the alleged infringement. On the album liner notes, the song is credited to singer Chris Martin, bassist Guy Berryman, guitarist Johnny Buckland and drummer Will Champion, and its title was apparently inspired by a Frida Kahlo painting.
Who knows what a judge will find, but until it makes it that far, you be the judge. The 50-second mark in "If I Could Fly" is where things get interesting, according to Rolling Stone.

Satriani is widely recognized as a technically highly advanced rock guitarist, and has been described as a virtuoso[9][10]. He has mastered many performance techniques on the instrument, including Legato, two-handed tapping and arpeggio tapping, sweep-picking, volume swells, harmonics, and extreme whammy bar effects. One of his trademark compositional traits is the use of Pitch Axis Theory, which he applies with a variety of modes.[citation needed] During fast passages, Joe favors a technique known as legato (achieved primarily through hammer-ons and pull-offs) which yields smooth and flowing runs. He is also adept at other speed-related techniques such as speed picking (a rapid form of alternate picking) and sweep picking, but does not often use them.
Satriani has received 14 Grammy nominations[11] and has sold more than 10 million albums worldwide.[12] Many of his fans and friends call him "Satch," short for "Satriani". Other guitarists sometimes refer to him as "Saint Joe"; there are numerous t-shirts to this effect.[citation needed]
An influential guitarist himself,[13] Satriani has many influences, including jazz guitarists Django Reinhardt, Wes Montgomery, and Charlie Christian[14], and rock guitarists Jimi Hendrix[15] and Ritchie Blackmore[16].
On 4th December 2008, Satriani filed an action against the band Coldplay for copyright infringement, alleging that their work Viva La Vida used "substantial original portions" of his 2004 instrumental If I Could Fly.[17]

Satriani is now recording a new album with the Chili Peppers drummer Chad Smith and Sammy Hagar and Michael Anthony (ex-Van Halen).
The band is called, no joke, Chickenfoot.
As I wrote to my friend in an email earlier today:
"I bet Hagar put Joe up to it, cause Sammy is a dick like that.
"Look Joe, don't be a patsy! See, I was a patsy and those evil Van Halen brothers fucked me...you gotta be a hardass in this business Joe...hey, want to buy some Tequila? Cabo Wabo! Yeeaaaaahhhh! Best shit ever!"

I see the similarities, it's probably going to be bad for them.
But, that Coldplay song is terrible. I'm a fan of theirs, but I've been surprised at that song being "the single" from the new album. They played it and only it on most nightly show appearances, and it's just not a good live song. The repetitive tympani drums just make it raw and too boring. And I love myself some tympani drum!- So we all agree that "repetitive tympani drums" just bypasses FAIL and heads straight to DOOMED?TheBlueOne
