Fairey is sued:
http://www.huffingtonpost.com/20…"The Associated Press countersued an artist Wednesday over his famous image of Barack Obama, saying the uncredited, uncompensated use of an AP photo violated copyright laws and signaled a threat to journalism.
The artist, Shepard Fairey, sued the not-for-profit news cooperative last month over his artwork, titled "Obama Hope" and "Obama Progress," arguing that he didn't violate copyright law because he dramatically changed the image."

Fairey calls his changes to the image a "stunning, abstracted and idealized visual image that creates powerful new meaning and conveys a radically different message."
Not even after 3 days straight eating Mexican food can I produce a steaming pile of shit as big as that...
- anyone who talks that kind of shit about their work should raise a suspicion. screams of someone who spends their time in marketing books rather than the studioisakosmo

Such a Warhol wannabe. He is irrelevant now, totally lost it. When you here him speak, you can tell the dude masturbates to his own pic while wearing his "Clash" or "Ramones" tshirt.

I don't think anyone wanted to be warhol, but a lot of people wanted his fame. Basquiat wanted the fame, but who can blame him. I think he was smarter than Fairey.

so was this an officially commisioned illustration from the Obama campaign or what? seems odd the Obama people chose the 'obey guy' and never bothered to clear the image rights themselves.
- morilla0
If Fairey is gonna sue and open the door. Then Fuct and all the others he lifted should come out and sue him.

I think Fairey already knows he's lost this case. His lawyers are constantly keen to stress that he didn't profit from the huge amount of merch sales he made. In a black and white legal analysis, what Fairey chose to do with the money that his merch made is completely irrelevant, he sold the goods and received payment. Any charitable use of that money is mere plea bargaining material after the conviction has been secured. As far as the prosecution is concerned he sold that image on merch and the revenue was immense. Fairey's people know it and that's what they are wasting their time hammering home that he didn't personally profit from it.
He re-funnelled a lot of the profit back into making more merch. That doesn't get him off the hook, that merely proves he was investing in his business and its stock of goods.
I really do think he'll be fucked.

so like did andre the giant ever sue him?

"Let's face it. Shepard Fairey is terrified to sit down for a real interview that would address each and every issue leading to the events that have landed him in such an awkward situation, because the man is just not that smart. And he's well aware of it. Shepard Fairey is a jock that wanted to hang with skaters. He's a wheatpaster that dreamed of being a graff writer or bomber. He's the guy that liked Soundgarden but pretended that he was into hard core punk... He was the well-off art student from the east coast that would send fan mail to established street wear companies on the west coast, back in the early nineties. He is the kid that just wanted to be famous for being famous. Kind of like Paris Hilton. Or Nicole Ritchie."
- valid point!Not_Ghey
- I'm going to subsitute "Shepard Fairey" in this quote with other people's names. Kind of a "Madlibs."Mimio
