" If a hardware defect arises and a valid claim is received within the Warranty Period, at its option, Apple will either (1) exchange the part with a new, used or refurbished part that is at least functionally equivalent to the original part "

just a reminder

Keep going.
I had a BT problem and eventually emailed the chairman directly . . . and that got it sorted!

i have a friend who worked in the call center support field for many years. basically, they refuse your requests (sometimes no matter how resonable) to deter those unscrupulous folks who would take the time out of their day to wear down the support rep for a new battery. basically if you're willing to bitch and moan, be it nicely or aggressively, you WILL eventually get what you want.
this is true for any company out there, especially one the size of apple.after enough disgruntled customers blog about their experiences, to the public, the value of these warranties diminishes and apple certainly wants to avoid that.
it's just a matter of working your way through the tiers.
sad but true.
take it from me. i'm Steve Jobs.
- ribit0
have you told us why they are refusing?
have they told you exactly why?
does it match with what the warranty supposedly covers?
don't give up yet. I always see this sort of thing as a way to get to know they're upper management. (I once took a BT complaint up to COO level, which was sort of interesting)

they want your machine? say no way.
It's your work machine and you're in dire straits without it functioning at 100%.
The old saying goes: don't hesitate... escalate.
tell the person on the phone that apple sent you a faulty battery. when they don't want to give it to you or give you the runaround, politely ask to speak to a manager. They're obviously not the person you need to speak to - and/or don't fully understand your problem.
Hope it works out. If not - that's going to be the most bitter $80 you've ever spent.

if there is an apple store near by go there ask for manager
that usually works everytiem
MrD
(Oct 8 07, 16:07)I did that on friday, no results.
I spend 2 hours on the phone today, and nothing. This sucks.
- SteveJobs0
yeah, i've seen these 'female' store managers.
cleavage, but secks, win-win.
- MrD0
i noticed that most of the apple store managers are females
- SteveJobs0
ask a hot girl friend of yours to show a little cleavage and take it to the store manager with pouty lips.
then when she comes back with a new battery, tell her you owe her hot romantic butt secks in payment.
win-win.

second call they are refusing to fix the battery or send me a new one.
I dont know what else to do.
- Meeklo0
Gucci, that is my problem..
I'm just too damn nice.
I don't like to yell at people, when I do its only after a looooong time of meditation on the subject. It sucks but they are starting to piss me off..now they want me to send my computer.
- Gucci0
PS: my wife always reminds me that "you get more bees with honey than you do with vinegar"...
translation: be nice
... I have to be reminded a million times when I'm pissed off. Hopefully you're not as big an asshole as I am.
love, Caralho.

call the customer service department and complain like a motherfucker.
the same thing happened to me.
they have a bunch of old "in case" batteries in a warehouse they give to unsatified customers who's batteries have given them a problem.Besides. I think the apple guy told me 300 or 600 cylces was the cutoff. if it's 300 - i can't say you're that far off.
- Meeklo0
I'm recroding the conversation as well.
At first they said that there was no problem, then they made me wait on the phone for like 20 minutes and not, it looks like its not happening.
Apple makes the best products but customer service is really bad. I'm under extended warranty, why are they making me go through all this...
- kerus0
demand a manager, explain your case. if that doesnt work demand to speak to his boss. do not take no, they WILL give in. make sure to talk with a loudish indoor voice so everyone around can get a whiff of whats going on.
they WILL cave in.
- Meeklo0
I'm on the phone with them right now.
